This Refund & Returns Policy explains our practices regarding refunds, returns, and customer rights for these digital purchases. By purchasing from our website, you agree to the terms of this policy.
Digital Products – All Sales Final
Immediate Delivery: All our products are delivered digitally via email, with download links typically provided instantly or within minutes of purchase. Because of the immediate access and downloadable nature of digital goods, all sales are final. Once a digital product has been delivered or accessed, it cannot be “returned” like a physical item, and we do not offer refunds in such cases.
No “Change of Mind” Returns: We encourage you to review product descriptions, titles, and features carefully before purchase. Since our products are intangible and irrevocable once downloaded, we cannot offer refunds for change of mind or dissatisfaction after access is granted. Please ensure the item meets your needs before completing your order.
Exceptions to the No-Refund Policy
While we maintain a no-refund policy in general, we do make limited exceptions in good faith under specific circumstances. These exceptions are outlined below:
Accidental Duplicate Purchases: If you accidentally purchase the same digital product twice, we will refund the duplicate charge. Proof of the duplicate purchase (such as both order confirmations or transaction receipts) is required. Please contact us as soon as possible with your order details (see Section 5 on how to request a refund). Once we verify the duplicate purchase, we’ll gladly issue a refund for the extra charge.
Technical Issues on Our End: If a technical problem on our side prevented you from accessing or downloading the product, we will work with you to resolve it promptly. In most cases, this means providing a new download link or sending the files via an alternative method. Failed downloads or access issues are not considered valid grounds for a refund – instead, we will ensure you receive the product you paid for. If the issue is confirmed to be on our end and cannot be resolved within a reasonable time, we may, at our discretion, offer a refund or alternative remedy. (For example, if a file is corrupted and we cannot provide a working replacement, a refund may be issued in line with our legal obligations.)
Misrepresentation or Defective Content: We strive to describe our digital products accurately and ensure their quality. If you believe the product you received is defective or not as described (for instance, a file is corrupted or missing essential content promised in the description), please notify us. We will investigate and, if the product indeed does not match its description or has a serious defect, we will provide a suitable remedy. This typically involves correcting the issue by sending you a repaired file or the correct content. If we are unable to fix the problem, you may be entitled to a full or partial refund as required by law. (For example, under UK consumer law, digital content that fails to meet quality standards can warrant a refund for the portion of the purchase that is faulty.)
Important: No other exceptions beyond the above are typically allowed. Situations not eligible for refunds include: changing your mind about a purchase, deciding you no longer need the product, finding an alternative product you prefer after purchase, or lack of technical ability to use the product. We also cannot issue a refund if our system records that the digital product has been accessed or downloaded to your device (even if the purchase was “accidental”). In other words, once you have the content, the sale is final.
All refund decisions remain at the sole discretion of Vital Nimbus management, within the bounds of applicable consumer law.
Download and Access Issues
If you encounter any problem receiving or accessing your digital product, we are here to help ensure you get what you paid for:
Non-Receipt of Email/Product: If you do not receive the download email within a few minutes of purchase, first check your spam/junk folder. If it’s not there, contact us and we will resend the access link or files promptly. There is no additional charge for resending product links.
Failed or Incomplete Downloads: If your download is interrupted or the file won’t open, contact our support for assistance rather than seeking a refund. We will provide guidance or an alternate download method until you can access your purchase. As noted, a failed download due to technical issues is not a basis for a refund since we can typically resolve the issue by ensuring successful delivery.
Customer Technical Requirements: Please ensure that you have the necessary device, software, and internet connectivity to download and use the product. We cannot be responsible for refunds due to lack of required software or insufficient internet capabilities on the customer’s end. However, we will do our best to assist you in troubleshooting any issues.
In summary, any access issues will be addressed with support and redelivery of the digital content, not with returns. We are committed to helping you enjoy your purchase.
Your Consumer Rights (US, UK, EU and Other Regions)
Our refund policy is designed to be fair and in compliance with applicable consumer protection laws in the jurisdictions we serve. While we generally do not offer refunds on digital goods, nothing in this policy is intended to limit any legal rights you have as a consumer. Below are important notes on how our policy aligns with major consumer rights laws:
United States: In the U.S., sellers of digital products are not legally required to provide refunds as long as a clear “all sales final” policy is disclosed and agreed to before purchase. Vital Nimbus fulfills this requirement by presenting our no-refund terms at checkout. By completing your purchase, you acknowledge that you understand and agree that the sale is final. (This transparency also helps us comply with payment processor rules and prevent disputes.)
European Union & United Kingdom (14-Day Cooling-Off Period): Customers in the EU and UK usually have a statutory 14-day “cooling-off” right of withdrawal for many purchases, during which you can cancel your order for any reason. However, this right does not apply to digital content that has been delivered with your consent before the 14 days elapse. EU/UK law allows sellers to waive the 14-day cancellation right for digital products, provided you give explicit consent to immediate delivery and acknowledge that you’ll lose the right to withdraw once the download or streaming of the content begins. Vital Nimbus operates in compliance with these rules. During checkout, you will be asked to agree to immediate digital delivery of your product. By agreeing and downloading/accessing the content, you waive your 14-day cancellation right for that purchase, meaning you will not be able to cancel for a refund after access is provided. If you prefer to retain your EU/UK withdrawal right, you must refrain from downloading or accessing the product and contact us within 14 days of purchase to cancel. We will honor any valid withdrawal requests before the content is downloaded or delivered to you. Once download/access has started, your right of withdrawal is considered waived by law.
EU/UK Product Quality Guarantees: Separately from the “cooling-off” rule, consumer laws in the EU and UK provide that digital products must be of satisfactory quality, fit for purpose, and as described. If a digital product is faulty, defective, or not as advertised, consumers are entitled to remedies such as repair or replacement, or a refund if the problem cannot be fixed. Vital Nimbus fully upholds these rights. If you encounter a significant issue with the content (e.g. an e-book file that won’t open or content that differs materially from what was promised), please let us know (see Section 5). We will correct the issue or offer an appropriate remedy in line with your statutory rights. For instance, under the UK Consumer Rights Act 2015, if digital content you bought is defective and we cannot resolve it, you could be entitled to a refund for that product. Similarly, EU directives require us to fix digital content problems or refund the customer when a fix isn’t possible. We take these obligations seriously and will work with you to reach a fair solution.
Other Jurisdictions: If you reside in a jurisdiction with consumer protection laws concerning digital goods (such as Australia, Canada, etc.), we will adhere to any mandatory rules regarding refunds or returns for digital products in those regions. Generally, our “no refund” policy will apply except where overridden by local law.
No Effect on Statutory Rights: This Refund & Returns Policy does not affect any rights you are entitled to under applicable law. In the event that local laws grant you additional rights or remedies, those will prevail to the extent required. Our goal is to be transparent and compliant globally.
How to Request a Refund or Assistance
If you believe you qualify for an exception refund (such as a duplicate purchase) or need assistance with a product issue, please follow the steps below:
Contact Us Promptly: Send an email to support@vitalnimbus.com (or use the contact form on our website) to initiate your request. Please contact us as soon as possible, ideally within 14 days of your purchase (and no later than 30 days after purchase) for us to consider your request. In your message, include your name, order number, purchase date, the product name, and a clear explanation of the issue or reason for your request. If requesting a duplicate purchase refund, attach proof such as both order receipts or payment confirmations.
Our Review Process: Upon receiving your request, our team will review the details and may follow up for additional information or clarification. We may ask for evidence of the issue (for example, a screenshot of an error opening a file) to better assist you. Please note that providing sufficient information will help us resolve your case faster.
Resolution and Timeline: We aim to resolve all refund/exchange requests or technical issues as quickly as possible. You will receive a response from us via email typically within 5 business days of your request, informing you of the outcome or next steps. If an exception refund is approved, we will issue the refund to your original payment method (e.g. the same credit card, PayPal, or Stripe transaction used for purchase) within about 5–10 business days of approval. (Please be aware that your bank or payment provider may take additional time to reflect the credit in your account.) If the request is denied, we will explain the reason and may offer alternative solutions if applicable.
Chargebacks: We kindly ask that you contact us to attempt to resolve any issue before filing a dispute or chargeback with your bank or payment platform. Since our policy is clearly stated and agreed at purchase, unwarranted chargebacks may be contested by us with evidence of your agreement. Working with us directly is usually the fastest way to fix problems and avoid misunderstandings. We are committed to fairness and customer satisfaction within the boundaries of our policy.
